HARBOURS ACT 1964 (AS AMENDED) THE POOLE HARBOUR (WORKS) REVISION ORDER 2015
NOTICE IS HERBY GIVEN that the Marine Management Organisation (MMO) has determined the application for The Poole Harbour (Works) Revision Order 2015 ("the Order") made on behalf of Poole Harbour Commissioners ("the Applicant"), under Section 14 of the Harbours Act 1964 ("the Act") on 06 June 2014.
The Order authorises the development and modernisation of the commercial Port infrastructure consisting of the extension of and construction of quays, the infilling of Poole marina and the deepening of existing berths. The improvements are considered necessary to ensure the ports long term viability.
The MMO has taken into consideration all matters listed in paragraph 19(1) of Schedule 3 to the Act, but in particular, the Environmental Statement (ES) supplied with the application, the responses to consultation and all representations made. Public notices were placed in this publication inviting representations in accordance with the Act. The MMO has made minor modifications to the drafting of the Order that it considers appropriate. The MMO concluded that the environmental impacts of the works authorised by the Order had been adequately identified, described and assessed and is satisfied that the mitigation proposed in the ES is sufficient, in combination with the conditions applied to the associated marine licence, to enable the approval of the application. The MMO is satisfied the Order is desirable in respect of purposes set out in section 14(2)(b) of the Act and has authorised making of the Order with amendments and modifications which it considers necessary and appropriate. The Order, associated marine licence and full details of the decision, including the environmental information provided, the main reasons and considerations on which the decision was based can be found at http://www.marinemanagement.org.uk/licensing/publicregister/harbour.htm . The Order comes into force on 10 July 2015 Any person who wishes to challenge the validity of the decision to make the Order, may, within 6 weeks from the date on which the Order becomes operative, make an application for that purpose to
the High Court.
