A MAN who was jailed for attacking his girlfriend and killing her unborn baby boy will not face having his prison term increased.

Asa Davison, 35 and of Gillingham, was convicted of child destruction, inflicting grievous bodily harm with intent, assault occasioning actual bodily harm and perverting the course of justice following a trial at Bournemouth Crown Court.

As reported, a request was made to the Attorney General's Office (AGO) to consider appealing the life sentence with a minimum term of 12 years to the Court of Appeal under the unduly lenient sentence scheme.

However, it has now been confirmed the case will not be referred.

A spokesperson for the AGO said: “The Solicitor General was shocked and appalled by this case.

“After careful consideration the Solicitor General has concluded that this case cannot properly be referred to the Court of Appeal.

"A referral under the unduly lenient sentence scheme to the Court of Appeal can only properly be made if a sentence is not just lenient but unduly so, such that the sentencing judge made a gross error or imposed a sentence outside the range of sentences reasonably available in the circumstances of the offence.

"The threshold is a high one, and the test was not met in this case.”
