A MAN has been found guilty of raping a woman after following her around the streets of Bournemouth and Poole for more than an hour.
Hasan Kyoybasha, 30 and of Ashley Road, Poole, was on trial at Bournemouth Crown Court accused of rape and sexual assault by penetration.
Prosecutors alleged that Kyoybasha carried out the sex attack on the woman, who is aged in her 30s, in the early hours of the morning in Branksome on Sunday, September 5 last year.
Following a seven-day trial, jurors yesterday found the defendant guilty of both offences.
The unanimous verdicts were reached after just shy of two hours of deliberations.
Kyoybasha stood motionless in the dock as the foreman returned the verdicts.
Judge Jonathan Fuller QC, who presided over the trial, said: “A custodial sentence is inevitable and in a case like this a substantial custodial sentence, so he will be remanded in custody until the sentencing date.”
During the trial, jurors were told the complainant had been on a night out with a friend in the Triangle area of Bournemouth when she left alone.
She could not remember leaving the venue but while walking in an area she did not know she was approached by Kyoybasha, who was on a bike.
The woman told police the defendant kept “badgering” her even after she told him to “leave me alone”.
In relation to the sex attack, the complainant said she opened her eyes to the defendant on top of her “doing stuff”.
She said Kyoybasha kept looking around as if he was trying to make sure he did not get caught.
The court heard the incident took place outside near Poole Road, Branksome, after the defendant was in close proximity to the woman as she walked various streets for around an hour and 45 minutes.
Giving evidence from the witness box, the defendant claimed the sexual intercourse was consensual.
Following the jury’s verdicts, Judge Fuller QC requested a pre-sentence report from the probation service and an updated victim impact statement ahead of the sentencing hearing, which is scheduled to take place on Maundy Thursday, April 14, at Bournemouth Crown Court.
The court heard Kyoybasha had no previous convictions. The judge said the court would be assisted by the pre-sentence report to obtain further information in relation to the defendant.
The Daily Echo requested Kyoybasha's custody image from Dorset Police. The force said it was not able to release the image before sentencing.
